If you work in Qatar as an expatriate, you should know your End-of-Service Benefits in Qatar. The Labour Law (Law No. 14 of 2004 and later updates) explains gratuity, eligibility, and contract rules. These protections help you plan for the end of your employment and secure fair compensation for your service.

In this guide, we explain the law in simple terms, show the gratuity formula, and walk through clear examples. We also highlight key rules that affect you when a contract ends.

The Legal Framework

Qatar Labour Law covers most private-sector jobs. If you do not work under a special regime—such as a government entity, certain oil and gas employers, or free zones—the Labour Law applies to you. Article 54 states your right to gratuity after one year of continuous service. Employers calculate gratuity on basic salary only, not on allowances or bonuses.

Gratuity Calculation

  • Minimum entitlement: Three weeks of basic pay for every completed year of service.
  • Salary base: Employers use your last basic monthly salary only.
  • Partial years: They calculate part-years proportionally.
  • No cap: Your gratuity grows with every year of continuous service.

Formula: Gratuity = (Basic Monthly Salary ÷ 4.33) × 3 × Years of Service

Eligibility Conditions

  1. Minimum service: Complete at least one year of continuous service.
  2. Resignation or termination: Receive gratuity in both situations once you meet the minimum service.
  3. Misconduct rule: If your employer dismisses you for serious misconduct (Article 61), you may lose gratuity.
  4. Unused leave: Get paid for any annual leave you did not take.
  5. Repatriation: Your employer pays for your ticket home, unless you legally transfer sponsorship.

Contract Types and Impact

  • Indefinite contracts: You receive gratuity after resignation or termination once you complete one year.
  • Fixed-term contracts: You receive gratuity when you finish the term. If an employer ends the contract early without valid cause, you still receive gratuity and may receive compensation.
  • Renewed contracts: When a contract renews, your years count continuously for gratuity.

Step-by-Step Calculation

  1. Confirm you have at least one year of service.
  2. Find your last basic monthly salary (exclude allowances and overtime).
  3. Calculate weekly wage: Basic Monthly Salary ÷ 4.33.
  4. Apply the formula: Weekly Wage × 3 × Years of Service.
  5. Add other dues: unused leave, final salary, and airfare if applicable.

Worked Examples

Scenario 1: Resignation after 3 years

  • Basic salary: QAR 5,000 → Weekly wage = 5,000 ÷ 4.33 = QAR 1,155
  • Gratuity per year: 1,155 × 3 = QAR 3,465
  • Total for 3 years → QAR 10,395

Scenario 2: Termination after 7 years

  • Basic salary: QAR 8,000 → Weekly wage = 8,000 ÷ 4.33 = QAR 1,848
  • Gratuity per year: 1,848 × 3 = QAR 5,544
  • Total for 7 years → QAR 38,808

Scenario 3: Completed 2-year fixed term

  • Basic salary: QAR 6,500 → Weekly wage ≈ 6,500 ÷ 4.33 ≈ QAR 1,500
  • Gratuity per year: 1,500 × 3 = QAR 4,500
  • Total for 2 years → QAR 9,000

Scenario 4: Resignation after 4 years 6 months

  • Basic salary: QAR 4,200 → Weekly wage = 4,200 ÷ 4.33 = QAR 970
  • Gratuity per year: 970 × 3 = QAR 2,910
  • 4 years = 2,910 × 4 = QAR 11,640
  • 6 months (½ year) = 2,910 ÷ 2 = QAR 1,455
  • Total → QAR 13,095

Other Considerations

  • Payment deadline: Employers should pay all dues within the legal timeframe after your contract ends.
  • Better terms: If your contract offers higher benefits, those terms apply.
  • Company funds: Employer savings or gratuity funds remain valid if they meet or exceed the legal minimum.
