The Solicitor General assists the Attorney-General in carrying out the duties of the Office of the Attorney-General. The position is established under Section 9 of the Office of the Attorney General Act.
The President of Kenya appoints the Solicitor General, subject to approval by the National Assembly, from a list of candidates recommended by the Public Service Commission.
🔹 Key Functions of the Solicitor General
✔ Supports the Attorney-General in legal advisory functions.
✔ Supervises court cases (appeals, petitions) on behalf of the Attorney-General.
✔ Manages legal and administrative functions of the Office of the Attorney-General.
✔ Handles disciplinary matters for State Counsel and staff.
✔ Coordinates legal development strategies for government services.
✔ Serves as an alternate chairperson of the Disciplinary Tribunal and College of Arms.
✔ Member of the Council of Legal Education (oversees legal training and professional standards).
✔ Oversees pupillage programs for law graduates in the Attorney-General’s Office.
🔹 Removal from Office
The Solicitor General may be removed by the President for:
✅ Violation of the Constitution or any other law.
✅ Gross misconduct in or outside the office.
✅ Physical or mental incapacity affecting performance.
✅ Incompetence in duties.
✅ Bankruptcy.
