A Returning Officer (RO) in Kenya plays a critical role in ensuring that elections are conducted in accordance with the law. As an official appointed by the Independent Electoral and Boundaries Commission (IEBC), the Returning Officer must remain impartial in the execution of their duties.

Functions of the Independent Electoral and Boundaries Commission (IEBC)

The IEBC is responsible for overseeing and conducting referenda and elections for elective positions established by the Constitution of Kenya and any other elections as mandated by an Act of Parliament.

Role of a Returning Officer

The Returning Officer primarily operates at the constituency level and oversees election processes within their jurisdiction. All Presiding Officers at polling stations report to the Returning Officer.

Key Responsibilities of a Returning Officer:

  • Announces election results for their designated electoral unit.
  • Signs official election results declaration forms.
  • Forwards official results to the national tallying center in cases where an electronic transmission system is used.
  • Submits official result declaration forms to the national tallying center.
  • Declares the winner in an electoral unit.
  • Signs and issues certificates of election to winning candidates.
  • Oversees the recruitment, training, and deployment of election officials.
  • Resolves disputes regarding spoiled or rejected votes.

Role of a Deputy Returning Officer

The Deputy Returning Officer (DRO) acts as an assistant to the Returning Officer and ensures the smooth execution of election processes.

Key Responsibilities of a Deputy Returning Officer:

  • Assists the Returning Officer in their duties.
  • Performs tasks assigned by the Returning Officer.
  • Takes over the Returning Officer’s responsibilities in their absence.

Qualifications for a Returning Officer and Deputy Returning Officer

To be eligible for appointment as a Returning Officer or Deputy Returning Officer, candidates must meet the following qualifications:

  • Be a Kenyan citizen of high integrity and non-partisan.
  • Hold a Degree or Diploma from a recognized institution.
  • Be computer literate.
  • Possess effective communication and report-writing skills.
  • Have the ability to manage people, sensitive data, and election materials.
  • Be proficient in data computation.
  • Be available for the entire by-election period.
  • Reside in the constituency where the by-election is being conducted.

The role of a Returning Officer is vital in maintaining the credibility, transparency, and fairness of Kenya’s electoral process. Their integrity and competence ensure that elections are free and fair, upholding the democratic principles enshrined in the Constitution.
