Functions of the Kenya National Examinations Council (KNEC)

The Kenya National Examinations Council (KNEC) is a statutory body established under the Kenya National Examinations Council Act. It is responsible for setting and maintaining examination standards in Kenya at basic and tertiary education levels.

Legal Status and Powers

As a body corporate with perpetual succession, KNEC has the authority to:

  • Sue and be sued in its corporate name.
  • Acquire, hold, charge, and dispose of movable and immovable property.
  • Borrow funds and make investments for its operations.
  • Enter into contracts for the execution of its functions.
  • Undertake lawful activities necessary for fulfilling its mandate.

Composition of the Kenya National Examinations Council

KNEC comprises members appointed by the government to oversee its operations. The Council includes:

  • Chairperson – Appointed by the President.
  • Principal Secretary for Education (or a representative).
  • Principal Secretary to the National Treasury (or a representative).
  • Officer in charge of quality assurance and standards in the Ministry of Education.
  • Director of the Kenya Institute of Curriculum Development.
  • Secretary of the Teachers Service Commission.
  • Additional members appointed by the Cabinet Secretary for Education, including:
    • One representative for persons with disabilities.
    • One representative from technical and business training institutions.
    • One representative from the private sector involved in education management.
  • Chief Executive Officer of the Council.

The Chairperson and appointed members serve a four-year term, with eligibility for one reappointment. The Chief Executive Officer serves for five years and can be reappointed for one additional term.

Functions of the Kenya National Examinations Council

KNEC plays a crucial role in ensuring the integrity, credibility, and international recognition of Kenya’s national examinations. Its key functions include:

Examinations and Certification

  • Setting and maintaining examination standards at basic and tertiary education levels.
  • Conducting public academic, technical, and professional examinations.
  • Awarding certificates and diplomas to candidates.
  • Ensuring that certificates or diplomas are not withheld from candidates by institutions or individuals.
  • Replacing lost or damaged certificates or diplomas upon valid proof of loss.

Verification and Recognition

  • Confirming the authenticity of certificates and diplomas upon request from:
    • The government.
    • Public institutions.
    • Learning institutions.
    • Employers.
    • Other interested parties.
  • Promoting the international recognition of qualifications awarded by KNEC.

Research and Policy Advisory

  • Conducting research on educational assessment to improve examination standards.
  • Advising public institutions on the development and use of assessment systems.
  • Advising the government on policy decisions affecting national examinations.

Other Functions

  • Performing any additional roles necessary to fulfill its mandate.

Powers of the Kenya National Examinations Council

KNEC has the authority to enforce its mandate by:

Regulation and Compliance

  • Making rules to regulate:
    • The conduct of examinations.
    • The confirmation of examination results.
    • The issuance and replacement of certificates and diplomas.
  • Withholding or canceling results of candidates involved in examination irregularities.

Administration and Collaboration

  • Appointing education and training officers (e.g., school heads) to assist in administering exams.
  • Equating foreign qualifications with KNEC standards.
  • Conducting examinations for foreign states upon request.
  • Administering examinations outside Kenya upon request.
  • Collaborating with foreign and local examination bodies to:
    • Conduct joint examinations.
    • Award joint certificates or diplomas.
    • Offer technical advice on examination systems.
  • Aligning its regulations with the Data Protection Act to safeguard personal information.

Operational and Financial Authority

  • Entering into partnerships with local and international organizations for education-related projects.
  • Offering examination and advisory services to private institutions.
  • Managing financial resources effectively to sustain examination operations.
