How to File NITA Returns on iTax in Kenya

Employers in Kenya are required to pay an annual NITA levy fee of KES 600 per employee, including casual laborers. The process is managed through iTax and the Kenya Revenue Authority (KRA). Below is a step-by-step guide on filing NITA returns and making payments.


Steps to File NITA Returns on iTax

  1. Log in to iTax
    • Access the iTax portal via iTax Website.
    • Enter your PIN and password, then log in.
  2. Access Returns Menu
    • Navigate to the “Returns” menu.
    • Select “File Return”.
  3. Select Tax Obligation
    • Choose “Income Tax PAYE” as the tax obligation.
  4. Download the PAYE Return
    • Use the link provided to download the PAYE return form.
  5. Fill in the PAYE Return
    • Complete the form with the required details.
    • Navigate to the “M1 (NITA Levy Details)” sheet in the return form.
    • Declare details for each employee on the payroll within the accounting period.
  6. Validate the Return
    • Ensure all details are accurate.
    • Validate the file to generate a ZIP file.
  7. Upload and Submit the Return
    • Upload the validated ZIP file on the iTax portal.
    • Submit the file and download the returns receipt. A copy will also be sent to your iTax-registered email.
  8. Register Payment
    • Go to the “Payments” menu and select “Payment Registration”.
    • Click “Next” to proceed.
    • Select:
      • Tax Head: Agency Revenue.
      • Tax Subhead: NITA Levy.
      • Tax Period: Select the relevant period.
  9. Confirm and Add Payment
    • Confirm that the NITA levy amount from the return is pre-populated.
    • Click “Add”, choose your mode of payment, and submit.
  10. Make Payment
    • Download the payment slip.
    • Proceed to make the payment through:
      • Bank channels.
      • Mobile payments (e.g., M-Pesa).
      • Debit or credit cards.
    • A copy of the payment slip will be sent to your iTax-registered email.

NITA Levy Penalties

  • Late Payment: 5% penalty on the unpaid amount.
  • Non-Compliance:
    • Fine up to KES 100,000.
    • Penalty up to KES 50,000 for each year of non-compliance.
